LUMA 光 Terms of Use and EULA
Last updated: 26 October 2026
Please read these terms before you install or play LUMA 光. They cover your licence, the one-time unlock, refunds and taxes.
1. Agreement and scope
These Terms of Use (the “Terms”) are an agreement between you and Nami Shams Game Studios, a brand of ICSL FZE, [REGISTERED ADDRESS], United Arab Emirates (“we”, “us”) for the game LUMA 光 and its in-game content (the “Game”). By downloading, installing or playing the Game you accept these Terms. If you are under the age of majority in your country, you confirm that a parent or guardian has agreed to them on your behalf. If you do not accept them, please do not install the Game.
For Apple devices these Terms form the end user licence agreement (EULA) for the Game, supplementing Apple's standard Licensed Application End User License Agreement; if they conflict, the Apple terms prevail only on the matters listed in section 15.
2. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Game on devices you own or control, for private, non-commercial entertainment, subject to these Terms and to the usage rules of the store from which you obtained it (Apple Media Services Terms, Google Play Terms of Service). The Game is licensed, not sold.
3. What you may not do
You may not, except where mandatory law allows it: copy, modify or distribute the Game; decompile, reverse engineer or extract assets, music, illustrations or story text; circumvent technical protections, the purchase check or the unlock; use cheats or tools that interfere with leaderboards; rent, lease, or sublicense the Game; or use the Game's characters, artwork, music or story commercially without our written permission. Personal screenshots, gameplay videos and streams are welcome and permitted; please credit the Game.
4. Free content and the full journey
The first chapter of the Game (twelve gardens) is free. The further chapters of the story, and the further content included in “The Whole Journey” at the time of purchase, are unlocked by a single one-time, non-consumable in-app purchase. We may add free updates and, in future, separate content; we will describe any separately sold content clearly before you buy it. LUMA II and LUMA III will be separate games and are not part of this purchase unless we expressly say so.
5. In-app purchase terms
- Merchant of record. Your purchase contract for the unlock is concluded with Apple (iOS) or Google (Android) as seller or merchant of record under their respective terms, and payment is processed by them. We are the provider of the digital content.
- Price. The price is shown in the Game and in the store before you confirm, in your local currency. Prices may differ by country and may change for future buyers; a price change never affects what you already own.
- Non-consumable and permanent. You buy the right to use the unlocked content on the Game for as long as the Game is offered and your account is in good standing with the store. It is not a subscription and does not renew.
- Restore Purchases. You may restore the unlock on any of your devices signed in to the same Apple ID or Google account by using “Restore Purchases” in the Game, free of charge.
- Family Sharing. Where the store allows and we have enabled it, the purchase may be shared with your family group according to Apple's or Google's rules.
- No real-money currencies, loot boxes or advertising. The Game contains none.
6. Refunds and right of withdrawal
Refunds are handled by Apple or Google, not by us, because they collect your payment. To request a refund:
- Apple: visit reportaproblem.apple.com, sign in, choose the purchase and select “Request a refund”, or contact Apple Support.
- Google Play: follow the steps in Google Play's refund policy at support.google.com/googleplay; for many purchases a refund is available within the period Google states.
Consumers in the EU, the UK and other regions with a statutory withdrawal right: you generally have 14 days to withdraw from a distance contract. For digital content, supplied immediately, this right may lapse once the content is unlocked with your prior express consent and acknowledgement that you lose your right of withdrawal, which the store asks for when you buy. This does not affect your statutory rights where the content is defective: if the unlock does not work, please contact us at namis@me.com and we will fix it or help you obtain a refund. Nothing in this section limits rights you have under mandatory consumer law.
7. Taxes
Displayed prices include value-added tax (VAT), goods and services tax or sales tax where such tax applies in your country and where Apple or Google collect it as merchant of record. Apple or Google calculates, collects and remits those taxes. Final amounts, including taxes and any currency conversion, are shown by the store before you pay. If your region requires an invoice, request it from the store.
8. Intellectual property
The Game, including its story, characters (including Neri, Mochi, the Origami Fox, the Shadow Woman and all other figures), world, name, logo, kanji mark, illustrations, animation, music, sounds, code and design, is owned by Nami Shams and ICSL FZE and is protected by copyright, trademark and other laws. © 2026 Nami Shams. Story, characters, world and all content by Nami Shams. All rights reserved. LUMA, Nami Shams and the vermilion seal mark are our marks. Third-party names such as Apple, App Store, Game Center, Google Play and iOS are marks of their owners. Cultural motifs (for example shrines, yokai, Korean and Chinese architecture) are used as respectful fantasy and not as historical or religious teaching.
9. Your content and feedback
The Game has no user-generated content. If you send us ideas or feedback, you allow us to use them to improve our products without obligation to you, but we will not use your personal data for anything else.
10. Game Center and online features
Any optional online feature (such as a leaderboard in the endless mode) is provided by Apple Game Center or Google Play Games Services, and is subject to the terms of those services. We do not moderate your platform profile. We may remove scores that result from cheating.
11. Updates, availability and changes
We may update the Game to fix errors, add content or keep it compatible with new operating systems. We aim to keep the Game working for as long as it is offered, but we cannot promise that it will run on all devices or in all future system versions. If we ever stop offering the Game, you will keep the right to use the version you have installed and, where the store allows, to re-download it.
12. Age
The Game is suitable for ages 4 and above and contains no violence, gambling, or mature content; it contains mild fantasy peril and one gentle, non-graphic emotional scene involving a companion animal. Children should use their device with the knowledge of a parent or guardian, particularly when making a purchase; we recommend using the purchase-control features of your device (Ask to Buy, Screen Time, Google Play Family Link).
13. Warranty and disclaimer
We provide the Game with care and as described. To the maximum extent permitted by law, and except as stated below, the Game is provided “as is” and “as available” without any warranty that it will be uninterrupted or error-free. Nothing in these Terms excludes or limits warranties and rights that cannot be excluded under mandatory consumer law, including your statutory rights to digital content that conforms to the contract.
14. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential loss, loss of data stored on your device (please keep backups), or loss of profit. We remain liable without limit for intent, gross negligence, death or personal injury caused by our fault, fraud, and any other liability which cannot be limited by law. In other cases, our total liability for the Game is limited to the amount you paid for the Game in the twelve months before the event, unless mandatory law provides otherwise.
15. Additional terms for Apple devices
- Acknowledgement. These Terms are concluded between you and us only, not with Apple. We, not Apple, are solely responsible for the Game and its content.
- Scope of licence. The licence is limited to a non-transferable licence to use the Game on Apple-branded products you own or control, as permitted by the Apple Media Services Terms.
- Maintenance and support. We are solely responsible for support and maintenance (see our support page). Apple has no obligation to provide any.
- Warranty. If the Game fails to conform to an applicable warranty, you may notify Apple, which will refund the purchase price; to the maximum extent permitted by law Apple has no other warranty obligation, and any other claims, losses or costs are our responsibility.
- Product claims. We, not Apple, are responsible for any claims relating to the Game, including product liability, legal or regulatory compliance and consumer-protection claims, and intellectual property claims.
- Legal compliance. You represent that you are not located in a country subject to a US government embargo or designated as a terrorist-supporting country, and that you are not on a US list of prohibited or restricted parties.
- Third-party terms. You must comply with applicable third-party terms (for example your wireless carrier's terms) when using the Game.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you once you accept them.
16. Additional terms for Google Play
Your purchase and use of the Game on Android is also governed by the Google Play Terms of Service. Google is not responsible for the Game or its support, and is not a party to these Terms except as stated in those terms.
17. Termination
You may stop using the Game at any time by uninstalling it. We may withdraw your licence if you materially breach these Terms and fail to correct the breach after notice, to the extent permitted by law. Sections that by nature survive termination (such as intellectual property and liability) survive. A refund requested through the store follows the store's rules.
18. Governing law and disputes
These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate where ICSL FZE is registered ([LICENSING AUTHORITY / FREE ZONE]), excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Subject to the mandatory rights of consumers, the competent courts are [COMPETENT COURTS]. If you are a consumer in the European Union, the United Kingdom or another place whose mandatory consumer law gives you the right to bring claims in your home courts or to rely on your home consumer law, nothing in this section removes that right. Before going to court we encourage you to contact us so that we can settle the matter amicably. EU consumers may use the European Commission's online dispute resolution platform for complaints, where available; we are not obliged and not generally willing to participate in consumer arbitration, unless the law requires it.
19. General
If any provision of these Terms is invalid, the remainder remains in force. Not exercising a right is not a waiver. We may change these Terms for good reason (for example new features or legal changes); we will publish the new version here and, for material changes, tell you in the Game or the release notes. Continued use after a change takes effect means acceptance for consumers where the law allows; otherwise we will ask for your agreement. These Terms are available in English and German; the English version prevails for interpretation, except where mandatory law requires the version in your language to prevail.
